7. Awards and Inconsistencies

7.1 This Agreement will wholly displace all previous certified agreements including the University of Southern Queensland Certified Agreement 1997-1999 and operates to the exclusion of other Awards which may otherwise apply to employees whose employment falls within the scope of this Agreement including:

  • Higher Education Academic Salaries Award 2002;
  • Universities and Post Compulsory Academic Conditions Award 1999;
  • Higher Education Contract of Employment Award 1998;
  • Queensland Universities (General Staff) Award  2000;
  • Tertiary Education Superannuation Scheme (TESS) Superannuation Award 1994.

7.2 Australian Workplace Agreements (AWA's)

7.2.1 The University may enter into Australian Workplace Agreements (AWA's) with employees.  Those AWA's may either operate to the exclusion of this Certified Agreement or prevail over the terms of this Certified Agreement to the extent of any inconsistency as specified in each AWA.

7.2.2 At the time of offering an AWA the University will offer a genuine and informed choice between the AWA and this Agreement. 

7.3 Relationship to University Policies, Procedures or Guidelines

Nothing in this Agreement shall be taken as incorporating as a term of this Agreement, any University policy, procedures or guidelines referred to in this Agreement, except where otherwise stated in this Agreement.
