This seminar charts important developments in the gradual shift in the law of torts away from notions of strict liability and toward notions of fault. Notwithstanding this shift, and the explosive growth of the fault-based tort of negligence, significant pockets of strict liability remain in the common law, arguably leading to incoherence. The seminar will note these, considering whether further reform of the law of tort towards general acceptance and application of fault across all of its constituent torts would improve the law.
Professor Anthony Gray is Associate Head – Research, at the USQ School of Law and Justice. He has published six research monographs since 2016, including his latest book The Evolution from Strict Liability to Fault in the Law of Torts with Hart Publishing (Oxford), on which this seminar is based. He has published more than 130 sole authored refereed journal articles since joining full-time academia in 2003.
